Development of Addendum II to the HSC FMP should provide an opportunity to better address the bait needs of whelk and eel pot fishermen. However, quota transfers must not unduly impact horseshoe crab populations or its competing uses.

The purpose of this Addendum, which is proposed by the states under Amendment 12, is to establish recreational fishing specifications for 2001 for summer flounder and for scup. Its provisions have no application beyond 2001.

Addendum II also clarifies several components of Amendment 3, such as updating the egg production rebuilding schedule and reconvening LCMTs to develop recommendations for area management based on the recent stock assessment.

In order to remain consistent with the goals and objectives set forth in Amendment 1 to the Interstate Fishery Management Plan (FMP) for Atlantic Sturgeon, uphold the enforceability of the FMP, and to minimize the risks to wild stocks the following terms, limitations, enforcement and reporting requirements have been established as standard requirements to be met in order for the ASMFC Sturgeon Management Board to grant an exemption to the moratorium on possession and harvest of Atlantic Sturgeon for the purposes of importation of non-Indigenous Atlantic Sturgeon and the development of private aquaculture facilities resulting in interstate/intrastate commerce.

Addendum 1 will include documentation supporting exemption requests for the purposes of 1) importation of non-Indigenous Atlantic Sturgeon and/or 2) the development of private aquaculture facilities. In addition, Addendum 1 shall specify terms, limitations, enforcement and reporting requirements for each exception to the harvest and possession moratoria as outlined in Section 4 of the FMP.

This Addendum requires the states to implement management programs for 2001 and 2002 that are identical or equivalent (through conservation equivalency) to the measures that were in place during 1998/1999 or 2000. Under this addendum states also have the option of implementing management measures that satisfy the management benchmarks that were in place in 1998/1999 or 2000.
